Agreement

Please read carefully.


            Integrity Inspection Service, herein after known as the Inspector agrees to conduct an inspection for the purpose of informing the client of major deficiencies in the condition of the subject property. THE WRITTEN REPORT IS THE PROPERTY OF THE INSPECTOR AND THE CLIENT AND SHALL NOT BE USED BY OR TRANSFERRED TO ANY OTHER PERSON OR COMPANY WITHOUT BOTH THE INSPECTOR’S AND THE CLIENTS WRITTEN CONSENT.

1)         This inspection of the subject property shall be performed by the Inspector for the Client in accordance with the Standards of Practice of the American Society of Home Inspectors, Inc. (ASHI®).If you would like a copy ask the Inspector or visit http:www.ashi.org

2)         The purpose of this inspection is to identify and disclose visually observable major deficiencies of the inspected systems and items at the time of the inspection only. Detached buildings are not included.

3)         This inspection is not intended to be technically exhaustive nor is it considered to be a GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, REGARDING THE CONDITIONS OF THE PROPERTY, ITEMS AND SYSTEMS INSPECTED AND IT SHOULD NOT BE RELIED ON AS SUCH. The Inspector shall not be held responsible or liable for any repairs or replacements with regard to this property, systems, components, or the contents therein. Company is neither a guarantor or insurer.

4)         THE INSPECTION AND REPORT DO NOT ADDRESS AND ARE NOT INTENDED TO ADDRESS CODE AND REGULATION COMPLIANCE, THE POSSIBLE PRESENCE OF OR DANGER FROM ASBESTOS, LEAD PAINT, UREA FORMALDEHYDE, SOIL CONTAMINATION AND OTHER INDOOR AND OUTDOOR SUBSTANCES. THE CLIENT IS URGED TO CONTACT A COMPETENT SPECIALIST IF INFORMATION, IDENTIFICATION, OR TESTING OF THE ABOVE IS DESIRED.

 Concealed defects are excluded from this inspection.  No system will be dismantled, and no finished surfaces will be damaged. The client agrees to assume all risk from conditions that are hidden from view at the time of inspection.   This includes items that are not visible due to snow, leaves, furniture, carpet, standing water stored items etc.

Whether or not they are concealed, the following are outside the scope of this inspection:

            Building code or zoning ordinance violations

            Geological stability or soil conditions

            Engineering analysis

            Prediction of life expectancy of any item

            Building value appraisal or cost estimates

Asbestos, formaldehyde, lead, water quality, air quality

            Condition of detached buildings

Furnace heat exchangers, Freestanding appliances, Security alarms

Water softener / purifier systems or solar heating systems. 

Thermostatic or time clock controls

            Pools, spas, underground piping.

Adequacy or efficiency of any system or component      

            Manufacturer recalled products             

            Basement Flooding and/or dampness

            Mold, Mildew, or other Bio-Growth

            Vermin such as Bats, Rats, Mice, Groundhogs, Moles, etc.          

5)      Read the sellers disclosure carefully.   Integrity Inspection Service is not responsible for conditions that are        disclosed or should have been disclosed or otherwise known to the previous owner of the property,                             

6)      Any matter concerning the interpretation of this Agreement, of the Inspection Report, or any claim based upon either of them shall be subject to binding arbitration to be performed by Resolute Systems LLC.   The Client agrees to notify the Inspector by telephone and in writing of any items in question and to allow the inspector or his agents access to the property to evaluate said items BEFORE any corrective action is taken.

7)      Attorneys Fees: If the client makes a claim against the inspector for any alleged error, omission or other act arising out of this work and fail to prove such claim, Client will pay all attorneys fees, arbitrators’ fees, legal expenses and costs incurred by inspector in defense of the claim.

8)      Severability:  The Client and the Inspector agree that should a court of competent Jurisdiction determine that any portion of this agreement is unenforceable, the remaining provisions and portions of this agreement shall remain in full force and effect.

9)      Receipt of Report:  The Inspectors agreement to perform the Inspection is contingent on the Clients agreement to the provisions, terms, conditions and limitations of this agreement.  If this agreement is not signed by the Client prior to or at the time the written inspection report is provided to the Client and Client objects to any of the terms of this agreement, Client shall return the written Inspection Report to the Inspector within seven(7) days and any fee that has been paid will be refunded to the client.  Failure to Return the written Inspection Report and payment of the Fee shall constitute the full acceptance of all of the terms of this Agreement by the Client.

10)  Pre-Closing Checklist.  I, the client, will use the pre-closing checklist (available on line at http://integrityinspection.com/assets/preclosechecklist.pdf) or provided with the home inspection before closing.  I will contact the inspector with any concerns I have before closing.

11)  The inspection service is conducted at the property. The physical on-site inspection of the property is a very valuable time of exchange of information between the Inspector and the Client. Any particular concern of the Client must be brought to the attention of the Inspector before the inspection begins. The written report will not substitute for Client's personal presence during the inspection. It is virtually impossible to fully profile any building with any reporting system. Unless Client attends and participates in the inspection process itself, the Client will have no chance of gaining all of the information that is offered.    Integrity Inspection Service reserves the right to mail or fax or email an amended report or specific pages of the report within 72 Hours of the Inspection.

12)  Pennsylvania Law Statement: A Home Inspection is a noninvasive visual examination of some combination of the mechanical, electrical or plumbing systems or the structure and essential components of a residential dwelling designed to identify material defects.  A Material defect is defined as a problem with a residential real property or any portion of it that would have a significant adverse impact on the value of the property or that involves an unreasonable risk to people on the property.   For the purpose of this inspection a significant adverse impact on the value of the property is defined as an impact greater than 2% of the purchase price of the property.  Inspector and client agree to submit to the jurisdiction of the courts of Northampton County, Pennsylvania as to any dispute between The Inspector and the Client

The undersigned have read understood and accepted the terms and conditions of this agreement and agree to pay the charges as specified on our website :  http:www.integrityinspection.com or in the email letter that has been sent.

Client agrees to pay the fee in accordance with the email that

directed the client to this contract.

 

The parties agree that the company’s liability for any mistake or omissions in this report shall be limited to a refund of the inspection fee paid.   The client agrees not to hold the company or its employees liable for any consequential damage.


By Acknowledging this Agreement you confirm that you have read, understood and accepted the terms and conditions of this agreement and agree to pay the charges agreed upon at or before the inspection.
